Terms of Use and Privacy Policy

Cluply is a social network for posts, clips, events, rooms, private messaging and voice or video calls. This page combines our Terms of Use and our Privacy Policy. By creating an account you accept both. If you do not agree with them, please do not use Cluply.
1. Who operates Cluply and how to reach us
Cluply is run by an individual developer — a natural person, not a company — who is the data controller for the personal data described on this page. For any question about this page, about your data, or to exercise any of the rights listed below, write to keepit.socialapp@gmail.com. We reply within 30 days, as required by the GDPR. If you need the operator's full name and postal address, for instance to send a formal data protection request, ask at that address and we will provide them.
2. The account you create
To use Cluply you register with an email address and a password, or through Sign in with Google or Sign in with Apple. Your profile holds the data you choose to provide: name, nickname, avatar, bio, interests, and optionally a phone number. Your email address is used to sign you in, to confirm your account and to recover access — it is never shown to other users.
3. Content you publish
Posts, clips, comments, reactions, events, polls and quizzes, rooms you create, and the photos, videos and audio you upload are stored so the service can show them. Content you publish publicly is visible to other users and may be indexed by search engines; content in a private account or a private room is visible only to the people you allow.
4. Messages and calls
Private chats, group chats and calls are delivered through our infrastructure so that they reach the other participants. Messages are stored so you can read your history on any device. Messaging is consent-based: a conversation starts only after the person you contacted accepts your request. Calls are carried by Stream (see the processors section) and their media streams are not recorded by us.
5. Technical and usage data
Like any online service we process technical data needed to run and secure Cluply: device model and operating system, app version, language, approximate region derived from your IP address, crash reports and error logs, and basic usage events (which screens are opened, which features are used). We do not build advertising profiles and we do not sell any of this data.
6. Your phone contacts
If you choose to find friends from your address book, the app reads your contacts on your device and sends only a short match key derived from each phone number to check whether that person is already on Cluply. We do not store your address book, and contacts who are not on Cluply are not kept on our servers. This feature is entirely optional and asks for your permission first; everything else in the app works without it.
7. Camera, microphone, photos and location
These permissions are requested only at the moment you use the feature that needs them: the camera and microphone when you record a clip or start a call, the photo library when you attach media, and location only when you attach a place to a post or an event. You can withdraw any of these permissions in your device settings at any time.
8. AI features
Cluply includes optional AI features: an assistant inside rooms, a glossary that explains terms, and speech transcription. When you use them, the text or audio you submit is sent to OpenAI to generate the answer. Do not put sensitive personal data into these features. If you never open them, nothing is sent.
9. Why we process your data and on what legal basis
We process your data to provide the service you asked for and to perform our agreement with you (Article 6(1)(b) GDPR): creating your account, showing the feed, delivering messages and calls. We rely on our legitimate interests (Article 6(1)(f)) to keep the service secure, prevent abuse and spam, and understand in aggregate how features are used. We rely on your consent (Article 6(1)(a)) for optional features such as contact matching and push notifications, and you may withdraw that consent at any time. Some processing is required to comply with our legal obligations (Article 6(1)(c)).
10. Who processes data on our behalf
We do not sell your data and we do not share it with third parties for their own marketing. We use a small number of processors who handle data strictly on our instructions: Google Firebase (authentication, database, file storage, push notifications and backend functions), Stream (voice and video calls), OpenAI (the AI features described above), Expo (app delivery and over-the-air updates), Amplitude (aggregate product analytics), Google Cloud Translation (translating public content into other languages) and OpenStreetMap (searching for a place when you attach one). We may also disclose data where the law requires it.
11. Where your data is stored and for how long
Cluply runs on Google Cloud infrastructure, which means your data may be processed outside your country, including in the United States. Such transfers rely on the European Commission's Standard Contractual Clauses or an adequacy decision. We keep your data for as long as your account exists. Crash and security logs are kept for a limited period and then deleted or anonymised.
12. Security
Traffic between the app and our servers is encrypted in transit. Access to production data is restricted to the people who need it, and database rules prevent one account from reading another account's private data. No online service can promise absolute security, so please use a strong, unique password and keep it to yourself.
13. Your rights
Under the GDPR you may request access to the personal data we hold about you, correct it, delete it, restrict or object to its processing, and receive a copy in a portable format. You may also withdraw consent at any time and lodge a complaint with your national data protection authority. To exercise any of these rights, write to keepit.socialapp@gmail.com.
14. Deleting your account
You can delete your account at any time from your profile settings, inside the app, without contacting us. Deletion removes your profile, your content and your messages from the service. Copies may remain in encrypted backups for a short period before they expire, and content other users have already reposted or received may persist in their own accounts.
15. Children
Cluply is not intended for children under 13, and in countries where the applicable age of digital consent is higher, not for users below that age. If we learn that an account belongs to a child below the applicable age, we delete it.
16. Rules for what you publish
You are responsible for everything you publish. Do not post content that is illegal, that infringes someone else's copyright or trademark, that harasses, threatens or defames another person, that sexualises minors, that promotes violence or hatred, or that is spam. You keep the rights to your own content; by publishing it you grant us the worldwide, non-exclusive, royalty-free licence needed to host it, display it and show it to the audience you selected, and that licence ends when you delete the content.
17. Rules for how you behave
Do not impersonate other people, do not attempt to access accounts that are not yours, do not scrape the service or automate it in ways that burden it, do not circumvent the consent rules for messaging, and do not use Cluply to distribute malware. Every user can report content or block another user, and reports are reviewed by our moderation team.
18. Moderation, suspension and termination
We may remove content or suspend an account that breaks these rules or the law. Where it is reasonable and lawful to do so, we tell you why. You may stop using Cluply and delete your account at any time.
19. The service is provided as it is
Cluply is offered without warranty that it will be uninterrupted or error-free. To the extent permitted by law we are not liable for indirect or consequential damages, or for content published by other users. Nothing here limits liability that cannot be limited by law, including liability for death, personal injury or intentional misconduct.
20. Changes to this page
We may update these terms and this policy as the service evolves. When a change is significant we announce it in the app before it takes effect. The date at the top always tells you when this page was last revised, and continuing to use Cluply after a change means you accept the updated version.
